What Data is Collected From Users?
Personal Information. Users will not be required to disclose any personally identifying information to TM Labs in order to access, and/or view the Website. Users may view all available merchandise, and campaigns (collectively “Merchandise”), participating businesses and non-profits, and most features of the Website without disclosing any personally identifying information.
In order to purchase any Merchandise offered for sale in the Website Users will be prompted to register an account by entering personal information into the Website, including the User’s email address or Facebook account information.
TM Labs may ask for additional identifying information from Users to help personalize each User’s experience on the Website, including but not limited to: name, gender, online social network login information (i.e. Facebook, Twitter), address, email, phone number and shipping and billing information. None of this information is required to access the Website, but it may be required to complete transactions on the Website, as described further below.
How Does TM Labs Use the Personal Data that it Collects?
TM Labs will use the personal information collected from Users to provide our services to Users and enhance the Users’ experience, including, but not limited to, notifying Users of new and/or expiring Merchandise; confirming orders made by Users; administering promotions, marketing campaigns; analyzing Website use; resolving disputes; troubleshooting technical and other problems; enforcing TM Labs’ agreements with Users; and customizing the Website’s content, layout, and services.
Web Tracking Information. TM Labs may use web-tracking technologies in order to operate the Website efficiently and to collect data related to usage of the Website. Collected data may include mobile phone preferences used to access the Website, IP addresses, pages visited, links clicked, and whether an email we’ve sent was opened. We may also collect information about actions that Users take while interacting with the Website. Although we do not correlate tracking information to individuals, some information collected, such as IP addresses, will be unique.
Users may manage how their mobile devices and mobile browsers share data, including Users’ locations, and handle cookies by adjusting the privacy and security settings on their mobile devices or personal computers. Instructions for adjusting these settings may be obtained by your mobile service provider or the manufacturer of your mobile device or personal computer.
We do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.
Is Users’ Data Shared With Others?
Why We Share and Use Data. We store and use information in order to deliver the best Website experience and service to the User. Other uses may include internal operational and administrative purposes and storing so that we may analyze and cater appropriate services for Users.
We may share aggregated, non-personally identifiable information publicly and with our partners, including businesses advertising Merchandise on the Website. This information will be consolidated from all Users and thus neither relates to nor identifies any individual.
With Other Users and Third Parties. Other Users cannot see any personal information of any other Users when using the Website, and we will not share Users’ personal information with any other Users.
Upon purchasing Merchandise, the User will be given the opportunity to voluntarily share his or her email address with the related business for the purpose of receiving information about promotions, specials, and other news from the business. TM Labs may also share aggregate, non-identifying information with businesses that advertise Merchandise on the Website, such as the gender, age, and city of residence, but this information will not be linked to any specific user. TM Labs will not share any other personal information with participating businesses, including but not limited to the User’s credit card information.
Users may voluntarily post their purchases to one or more social media platforms. If a User chooses to post to a social media platform through the Website, the User will need to enter his or her login information for the platform (i.e. Facebook, Twitter, Pinterest). TM Labs will not have access to this login information and the login information will not be stored on the Website. To manage the sharing of personal information with TM Labs when you connect to social media platforms through the Website, refer to the privacy policies and settings of the third party social media platforms.
Aggregate Website information that does not contain personal information may be disclosed to any third party, such as potential customers, business partners, advertisers, and funding sources, in order to describe our business and operations.
Can Personal Information Be Changed and Removed from the Website?
Accessing, Modifying and/or Deleting Personal Information. Users may review, update, correct, and/or delete personal information through the account management features available on the Website after they log into their TM Labs account. Users may express concerns about privacy data collection and how it is used by contacting firstname.lastname@example.org; Users may also request that their user profile or other personal information be deleted from the Website and/or removed from TM Labs mailing lists. Each email sent to Users also includes instructions for unsubscribing to TM Labs emails at the bottom of the email, and these requests will be processed as quickly as is practicable. TM Labs reserves the right to verify User identity in such cases.
Even after account modification or removal, copies of personal information may remain on the Website to the extent that it had been previously shared with a necessary third party. In addition, TM Labs may retain certain information in order to prevent identity theft and other illegal activities after an approved deletion. Removed information may remain in archives but will not be available to other Users or third parties.
How Does TM Labs Protect User Information?
However, as no storage or transmission is completely secure, we cannot guarantee that no breaches in security will be made. Without limitation of the foregoing, we are not responsible for the actions of unauthorized third parties that breach our security, and by using this Website you acknowledge that, while TM Labs will make every effort to protect Users’ personal information, TM Labs is not liable if Users’ personal information is viewed or tampered with by a third party. If TM Labs becomes aware of a data breach of the information stored on or for its Website, TM Labs will take reasonable efforts to notify Users of such a security breach within seven (7) business days of becoming aware of the data breach. These efforts may include, but are not limited to, an email notification and/or an announcement on the Website.
Other Information for Our Users
Eligibility. TM Labs does not intend that the Website will be accessed or used by children under the age of 16 years old, and such use is prohibited. The Website is designed and intended for adults, and all Users of the Website must be at least 16 years old. By using the Website you represent that you are at least 16 years old and understand that you must be at least 16 years old to create an account and purchase Merchandise on the Website.
TM Labs does not knowingly collect, use, or disclose personal information from Users who are under the age of 16 years old or otherwise without the authority, right, or capacity to represent themselves. If a User matches any of the aforementioned criteria, he or she is prohibited from both the access and usage of the Website, unless a legally authorized adult representative is using the Website on the User’s behalf (i.e. a parent or legal guardian).
CA Civil Code Section 1798.83. Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of personal information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the proceeding calendar year. In particular, the law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties.
